Terms of Service

Welcome to Charmer (“Charmer”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of the Charmer applications, websites, and related services (collectively, the “Service”). The Service is operated by OfferPulse Limited, Unique Business Identifier 79333511, with its registered address at Unit B, 11/F, 23 Thomson Road, Wan Chai, Hong Kong SAR China. By creating an account or using the Service, you agree to these Terms.
1. Eligibility
- You must be at least 18 years old to use the Service. We do not permit minors.
- You represent that you have the authority to enter into these Terms and that your use complies with applicable laws.
2. Account & Security
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Provide accurate, current information and keep it updated.
- We may require identity or age verification to help keep the community safe.
3. Subscriptions & Billing
- Charmer offers two paid access options: £15 for 1 month access or £25 for lifetime access. The billing descriptor may reference “wmart.online”.
- No free trials are currently offered.
- All payments are processed using 3D Secure authentication (Strong Customer Authentication) where applicable, adding an additional layer of protection against unauthorised use.
- Refunds: While subscription payments are generally non-refundable once access has been granted, we always aim to resolve issues fairly and promptly. If a payment was made in error, was unintended, or the customer did not recognise the charge, please contact us at support@charmr.xyz. We use real-time alert systems (including Ethoca and Verifi) to identify unrecognised or unwanted transactions and issue refunds proactively when appropriate. Nothing in this policy affects your statutory rights under applicable law.
- Chargebacks: If you believe a payment was made without your authorisation, please contact us first. In most cases we can resolve the issue or refund the payment immediately, which helps prevent unnecessary chargebacks. Filing a chargeback does not guarantee a refund if the transaction was valid, but we will always work with you in good faith to reach a fair solution.
- Payment Processing: Payments are handled by third-party processors. We do not store full card details on our servers.
- We may change prices or plans; changes will apply to future purchases after notice.
4. Acceptable Use & Community Guidelines
Charmer is a mainstream dating and social connection service. To help everyone feel safe and respected, you agree that you will not:
- Violate any law, including those relating to privacy, publicity, and intellectual property.
- Post or solicit illegal, non-consensual, exploitative, or underage content. Zero tolerance for any depiction of minors.
- Use the Service to buy, sell, advertise, or facilitate escorting, prostitution, or paid sexual services.
- Harass, threaten, or abuse others; send spam or scams; or engage in hate speech or incitement to violence.
- Publicly post pornographic content or explicit nudity on profiles or public areas. (Private, consensual adult messaging must still comply with these Terms and applicable laws.)
- Attempt to circumvent safety features, conduct scraping, reverse engineering, or interfere with the Service’s operation.
5. Profiles, Messaging & User Content
- You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, and transmit your content solely to operate and improve the Service.
- You represent you have the rights to the content you upload and that it does not infringe others’ rights.
- We may remove or restrict content that violates these Terms or applicable laws.
6. Safety Notice (No Background Checks)
Charmer does not conduct criminal background checks on users. Always exercise caution when interacting with others online or in person. You are solely responsible for your interactions.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by OfferPulse Limited or its licensors and are protected by applicable intellectual property laws. All rights not expressly granted are reserved.
8. Suspension & Termination
We may suspend or terminate your access if you violate these Terms or pose risk to other users or to the Service. You may delete your account at any time via settings.
9. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, OfferPulse Limited and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service. Our aggregate liability for all claims shall not exceed the amounts you paid to us in the 12 months preceding the claim.
11. Indemnity
You agree to defend, indemnify, and hold harmless OfferPulse Limited and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service or your breach of these Terms.
12. Governing Law & Disputes
These Terms are governed by the laws of Portugal, without regard to conflict of laws principles. Courts located in Lisbon shall have exclusive jurisdiction, unless your local consumer law provides otherwise.
13. Changes to the Service or Terms
We may modify the Service or these Terms. If changes are material, we will provide notice (e.g., by email or in-app). Continued use after the effective date constitutes acceptance of the revised Terms.
